Snowplains Limited Registration Contract

SNOWPLAINS LIMITED REGISTRATION CONTRACT 

The buyer hereby agrees to purchase a   Female / Male   Alaskan Malamute puppy from the litter born on  ________________ 20__.

Sired by _________out of Dam _________bred by Snowplains Alaskan Malamutes, for the price of $______.   $300 of the above purchase price is to be considered a non-refundable deposit, reserving buyer’s pick of the litter in the order the deposits were given. Seller will hold the puppy until a date agreed upon by both parties. The remaining balance ($_____) is to be paid by cash, cashier check, money order or Credit Card + 3%fee upon puppy reaching 6 weeks of age on _________________. The deposit is not refundable unless the seller is unable to furnish the buyer with the agreed-upon puppy. The seller agrees to furnish the buyer with the necessary health information, including all shot and worming records. The buyer understands that this puppy will only be eligible for limited registration with the AKC and has been fully informed of all of the restrictions involved with this form of registration. Puppy will be ready to go home upon reaching 8 weeks on_________________________. If being shipped, shipping costs are to be paid by the buyer before puppy is shipped. If puppy is not picked up or shipped by 8 weeks old, a $10 per day boarding fee will be charged for care and food for the puppy. 

Payment paid in full implies this contract is in force by all parties involved, even in the absence of signatures by seller or buyer.

THIS ANIMAL IS GUARANTEED AS FOLLOWS:

1. To be in good physical condition for the first 72 hours after the time of delivery. The buyer agrees to have the puppy examined by a veterinarian within 72 hours after the delivery time for a complete physical examination. If the puppy is not examined by a veterinarian within 72 hours, the below guarantees are no longer in effect. If a veterinarian finds the puppy to be in generally poor physical condition, the seller will replace the puppy with another puppy of comparable quality should the seller own or be able to secure such a dog within a reasonable period of time.

2. . To be free of any inheritable disease that cause death , free of any crippling/disabling hereditary genetic defects or serious impairment of vital functions in the puppy, until such puppy is one ( 1 ) year in age. If such an inheritable disease is documented by a veterinarian and presented to the seller with sufficient supporting evidence, the buyer will be entitled to a replacement puppy of comparable quality. The seller reserves the right to a second veterinarian opinion at the expense of the seller. Seller also offers a conditional (replacement) guarantee that your puppy is clear of hip dysphasia for 1 year from his/her whelping date.  We will not pay for the veterinary bills or travel expenses. If something is found with this puppy/dog’s hip’s all documents and proof of claim related to this 1st year period must be sent to Snowplains Alaskan Malamutes.  If we find that your claim is valid a pup of same sex will be offered to replace that pup. Shipping of both puppies to and from Snowplains Alaskan Malamutes is at the (buyer’s expense).

3. To be of sound temperament, that is, to be neither too shy, nor vicious as to render the dog an unfit companion. This guarantee of temperament is effective only until the dog reaches one year of age, if sold as a puppy, and is contingent upon reasonable proof that any defect in temperament is not the result of lack of proper care, training or abuse of the puppy on the part of the buyer. Seller does not guarantee size, weight, and coat length or eye color of  any puppy produced.

 
THE BUYER AGREES:  (buyer initials each line)

________1. Within 6 months of purchase, to Register the puppy with AKC and Avid (Microchip ID)  if applicable, and to use the kennel name "Snowplains" as the kennel prefix in the registered name of the dog.  (Example: Snowplains Rising Sun)

________2. Should Buyer decide to relinquish ownership of this puppy/dog at any time during its life for any reason, Buyer agrees to return puppy/dog to Seller. This dog may NOT be sold, placed or in any means ownership relinquished to another party unless agreed upon by Seller and expressed in writing by Seller to Buyer. If at any time Buyer is unable or unwilling to provide for this puppy/dog it must be returned to Seller under the terms specified above. If the buyer can find a suitable alternate home, and if the seller approves of this home, the right to repossess the puppy will be null and void.  The buyer must provide contact information, including all telephone numbers for the alternate home before seller approval will be given. Puppy’s purchase price is non-refundable.

 ________3. To refrain from breeding the above puppy, and further agrees to have the puppy spayed or neutered before the puppy has reached 7 months of age. Proof of procedure should be sent to Snowplains via fax, mail or scanned and sent by email. Upon receipt of proof the puppy's AKC registration form will be provided to the buyer. The buyer understands that if the above puppy is ever bred that none of the produced puppies will be eligible for AKC registration. The buyer further understands that if the above puppy is ever bred, or spaying/neutering by 7 months is not proven, the Seller's guarantees as outlined above are void and no longer apply.

________4. Buyer agrees that if the buyer has not met the proper requirements for housing and fencing upon available pickup date set above, the seller shall retain the puppy, for the buyer, for a period of up to but not exceeding 30 days from the original pickup date. At that time, if the buyer has not properly prepared for the new puppy with a kennel and/or approved fencing, the deposit is forfeit and the seller may then sell that puppy to another approved buyer.

________5. Buyer agrees that the dog will reside at the home of the Buyer, have access to a fenced yard, not be chained or tethered; and will be provided with proper housing, UTD Vaccinations and De-wormed, diet and proper grooming. We encourage and recommend that the buyer keep your puppy/dog on the highest quality food possible and regularly exercise your dog, keeping the dog fit and lean. Consumption of poor quality/bad food can cause all kinds of health problems and shorten the life expectancy of your dog. Our best recommendation is an All Natural Dog Food or as close to it as possible, with no meat by-products, chemical preservatives or additives.

  _______6. Buyer agrees to be responsible for all actions of the dog and to exercise precautions. The buyer will keep seller informed of any significant health, temperament or behavior problems encountered throughout the dog’s life. The Buyer will notify the Seller in writing of an address change or telephone number change within eight (8) weeks of such a change.

I HAVE READ AND FULLY UNDERSTAND THIS AGREEMENT:
Snowplains reserves the right to cancel a reservation should it be determined that a client may not be a suitable home during the term of the selection or waiting process. Snowplains reserves the right to cancel any reservation for any reason at its sole discretion. Upon such cancellation, a refund of the deposit shall be made. Persons placing reservations for the purchase of a Puppy hereby agree to and do indemnify and hold harmless Snowplains Alaskan Malamutes, from any and all damages or liability resulting from such cancellation.

All payments are non-refundable after being received by Snowplains Alaskan Malamutes / Breeder.

The buyer and the seller agree that this is the full and complete agreement that exists between the parties for the sale of this dog. Any agreements made prior to this are considered incorporated herein and any modifications made to this agreement shall be made in writing or such shall not be effective. By my signature I affirm that I have read, discussed and understood the terms and conditions of this agreement. Further, I agree to abide by the letter of the terms and conditions as well as the spirit of this agreement. I am aware of and fully understand the possible consequences of breaching this agreement. I sign this agreement of my own free will and without duress.

The Breeder/Seller neither makes nor implies any warranties or guarantees, express or implied, other than those written in the agreement including, without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between the Breeder/Seller and Buyer with respect to this sale. The Buyer's signature above or payment in full indicates that he/she has read, agrees and does understands all the conditions of the Sales Agreement / Contract of Sale. Any legal filings by the buyer must be filed in Colorado Springs,  El Paso County, Colorado Jurisdiction and the buyer will be responsible for all legal and incidental expenses incurred by Snowplains Alaskan Malamutes or the breeder in any case filed by the buyer that is ruled in the favor of Snowplains Alaskan Malamutes or the breeder.
